The criteria required for immigration and work visas are very strict. The different visas and conditions attached are veritable minefields. The USCIS (US Citizenship and Immigration Service) has a web at http://uscis.gov/graphics/index.htm. This contains useful information. Immigration laws change constantly and a daily up date can be found on www.ilw.com the "Immigration Portal".
Work visas and permits are confusing and an immigration officer is needed to explain.
The E-1 visa is for a treaty trader and E-2 visa is a treaty investor. The L-1 is for company transfers. Buying a business requires a substantial investment the E-2 visa is the most popular way to try and gain entry, (This does not automatically lead to a green card) it may on first application run for only 2 years but if business can be shown viable and profitable and meets the criteria it will probably be granted for 5 years. If you sell the business you are no longer eligible to remain in E-2 status unless another qualifying business is acquired or a change of visa status. A qualified immigration officer needs to be consulted. If you have a special ability in e.g. Business, Art Science, Education, Athletics an O-1 visa is required.
Most people want to apply for a green card but since 1989 it has a span of only 10 years and you must file an application to replace the card. If you plan to stay in the US and you have a green card it is better to become a naturalized citizen as soon as you are eligible usually between 3-5 years.
